GENERAL TERMS OF SALE
The website www.luma-jewels.com (hereinafter the "Website") is an e-commerce website published by the Initial L, SAS company, with a capital of 10,200 euros, which headquarters are located 9, rue Isaac Newton, 31700 Blagnac, FRANCE. The company is registered on the Toulouse Trade and Companies Register under the number 440 531 782, VAT number FR 94 531 440 782.
www.luma-jewels.com (hereinafter the "Website") offers a selection of products from the “LUMA” brand (hereinafter "Products") to non-professional buyers, individuals qualified as consumers, being older than 18 years and having full legal capacity (hereinafter "Customer").
These Terms and Conditions (hereinafter "Terms") are intended to fix the relationship between the Seller and the Customer browsing or making a purchase on the Website. They can be changed at any time without notice by the Seller. The applicable terms are those in effect at the date of the order.
Customer acknowledges, at the time of ordering, the terms and conditions of sale stated on this page and expressly accept them without any reservation.
Products for sale are those listed on the website www.luma jewels.com on the day the Consumer is consulting the website, within the limits of available stocks.
Descriptions and photos of the products sold on the website are as accurate and as true to reality as possible. However, colors, sizes, textures and other characteristics of the products can be affected by screens or internet browsers used to view them.
Because the products are handmade, some lengths shown may experience variations of more or less 10%. Similarly, some materials may present irregularities because of their natural character or the artisanal production.
The Customer acknowledges that photos, descriptions or accompanying graphics illustrating the products for sale on the Website are indicative and not contractual and do not engage the liability of the Seller for any error, omission or modification.
To place an order, the Customer agrees to communicate through the website only real and valid information necessary for the performance of the service subject to these Terms. The Seller shall not be held responsible for incorrect information by the Client resulting in failure of the service subject to these Terms.
The Client may at any time access to his/her data and modify it under "My Account".
All orders shall be deemed valid only after acceptance of the payment. The Seller shall be entitled to refuse any order for a customer under dispute on a previous order. After validation of the order by the Seller, the Customer will receive a confirmation email.
Orders are accepted within the limits of available stocks. The permanent or temporary unavailability of a product shall not, in any way, engage the responsibility of the Seller and shall not entitle the Client to compensation or damages.
The prices displayed on the website are quoted in euros, all taxes included, but excluding the postage fee for processing the order. The total price of the order (taxes and shipping included) is shown in the cart. The Seller reserves the right to modify its prices at any time without notice but the products will be charged based on the rate in effect on the validation of the order, subject to availability. In the event of delivery of products outside the French territory, taxes and customs formalities are the sole responsibility of the Customer, unless otherwise indicated.
5. PAYMENT METHOD
The Customer shall pay to purchase products on the Website with a credit card or debit card only via the secure platform of our partner Société Générale, or Paypal.
Customer must send his/her credit card number, depending on the type of card, the expiration date and the security code (3 digit number on the back of the card).
Customer's credit card is charged at the time of validation of the order for the entire amount. The Customer expressly acknowledges that the communication of his/her card number to the Seller is authorizing the debit of his/her account according to the products ordered.
The Customer warrants to the Seller, during validation of his/her cart, that he is in a legal situation with the issuer of the card.
The financial information will be transferred through a cryptographic protocol, to Société Générale or Paypal, without third parties having access to this information in any case.
According to the provisions of Article L 121-20-3 of the Consumer Code, the ordered products are delivered in the time indicated on the website and upon confirmation of the order, within 30 working days.
Once your order is validated, it is shipped within 48 hours (Monday to Friday, excluding holidays).
So that these deadlines are met, the Customer agrees to submit to the www.luma-jewels.com website complete and accurate information regarding the delivery address (such as: street number, building, stairs, access code, names and/or intercom numbers, etc..).
Delays specified on the Website and upon confirmation of the command are for guidance only and reflect the processing time of the delivery of the package. The Seller shall not be liable for the consequences of a delay caused by the delivery.
In the event the package is damaged on delivery, the Customer must verify with the carrier the condition of his/her Products and accurately report on the order form any missing or damaged item.
Products are delivered in France, European Union, and the rest of the world.
No delivery can be performed at a hotel.
For deliveries outside mainland France, the Customer agrees to pay all taxes due on the importation of goods, customs duty, value added tax and other taxes payable under the laws of the receiving country of the order.
7. RIGHT OF WITHDRAWAL AND ITEMS RETURNS
The Customer may return any product ordered on the website www.luma-jewels.com within 7 days from the date of receipt of the order, if the product does not suit him.
Any return or exchange request must be reported to our company by email prior the expiration of 7 days at the following address: email@example.com
We will then confirm the details of the procedure for return or exchange and, if required, the availability of the items.
However, Luma-jewels.com will not accept the exchange and refund of the jewels if all the following conditions are not met:
- The Customer must notify the Seller of its intention to return the product within the time limits,
- The Product must be returned in new condition, not having been worn or used, or have been the subject of any use,
- The Product must be returned in its original packaging, accompanied by the original invoice.
Shipping back the package remains the responsibility of the Customer, except in case of lack of conformity of the product delivered over the command.
If the product is defective or an error occurred during the preparation of the order, www.luma-jewels.com supports shipping and will reimburse the Client within 30 days.
The Customer must retain the proof of return.
Risk associated with returning the product is the responsibility of the Client.

Upon receipt and subject to these return conditions, the Seller will refund the order, original shipping costs out, by crediting the customer's bank account within 15 days of receipt of the package by the Seller.
Failure to comply with these conditions of return, we would be unable to return or exchange the item, and it would be returned at your expenses.

The products are covered by the legal guarantee of conformity and the legal warranty against hidden defects. The abnormal or improper uses of the products, as well as the consequences of such uses or external causes are excluded from the contractual guarantees.
To access the website and for all stages of the purchase process, from order to shipment and post services, the Seller has an obligation of means and responsibility cannot be engaged for any inconvenience or damage arising from the use of the Internet, including a break in service, external intrusion or presence of computer viruses or any force majeure.
9. FORCE MAJEURE
The occurrence of unforeseeable circumstances or force majeure, the obligations of the Seller and the Customer under the defined benefits in these Terms shall be suspended without any compensation for one of the parties.
Are considered as cases of force majeure or unforeseeable circumstances beyond those usually retained by the jurisprudence of French courts, total or partial strikes, lockouts, riots, boycotts or other actions in industrial or commercial disputes, civil disorder , insurrection, war, bad weather, epidemic, blocking of means of transportation or supplies for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal or regulatory changes forms marketing, computer failure, interruption of telecommunications, including wireline and wireless networks telecommunications, and other cases independent of the will of the parties prevents the normal execution of the contractual relationship.
In case fortuitous event or force majeure would extend beyond fifteen days, the contract may be terminated without any compensation for one or the other party.

11. INTELLECTUAL PROPERTY
Luma is a registered trademark. All text, logos, illustrations, images, videos, models, etc. being present on the website are the full property of the Seller and are reserved under copyright and the title of the intellectual Property and the world. Consequently, in accordance with the provisions of the Code of Intellectual Property, the only authorized use is for a private use. Any other use constitutes an infringement and is punishable, unless expressly authorized by the Seller.
12. APPLICABLE LAW
These Terms are governed by French law. If any term of these Terms is found void or unenforceable by a court of competent jurisdiction, the remaining provisions of the Terms remain in effect.
In case of dispute, the customer should first contact the seller to obtain a settlement. Failing agreement, only the French common law courts have jurisdiction, notwithstanding plurality of defendants or warranty.
